Terms of Service
1. Scope
These Terms of Service apply to all use of the Bierblock software and website (bierblock.app), operated by Christian Jäkl, Nesslbachweg 17, 9551 Tschöran, Austria. The German version of the general terms and conditions (AGB) is authoritative for the detailed contract terms.
2. Service description
Bierblock is a digital order management tool for non-commercial events such as club festivals and fire brigade festivals. It enables volunteer-run teams to take and coordinate orders during events.
3. User accounts
A user account is required to create events. Volunteers who use Bierblock purely to take orders do not need an account. You are responsible for keeping your login credentials confidential.
4. Permitted use
You may use Bierblock for lawful purposes only. You may not:
- Resell or sublicence the service
- Use it for commercial restaurant or hospitality operations
- Attempt to circumvent security measures or access other users' data
5. Pricing and payment
Current prices are published at bierblock.app/en/pricing/. Payment is processed via our payment provider. The Demo plan is free and requires no payment details. Monthly and yearly subscriptions renew automatically and can be cancelled anytime; the one-time purchase grants one month of access without a subscription.
6. Right of withdrawal for consumers
Consumers have a statutory right of withdrawal for distance contracts. The full withdrawal policy including the model withdrawal form and the online withdrawal form is available at bierblock.app/en/withdrawal/ and in the AGB (§ 3a).
7. Availability
We aim for high availability but do not guarantee uninterrupted service. Maintenance windows and technical issues may cause temporary unavailability. We are not liable for losses caused by service interruptions during events.
8. Data processing
By using Bierblock you agree to the processing of your data as described in ourPrivacy Policy.
9. Limitation of liability
The operator is liable without limitation for intent and gross negligence as well as under mandatory statutory provisions, in particular for damage to life, body or health. In cases of slight negligence, liability is limited to damage from the breach of essential contractual obligations and to the foreseeable, typical damage; this limitation does not apply to damage to life, body or health. Consumers retain all mandatory statutory rights (KSchG).
10. Changes to the terms
We may update these terms. Changes will be announced at least 60 days in advance on a durable medium. For consumers, amended terms become part of the contract only with express consent — silence does not constitute consent. Material changes give consumers the right to terminate before the change takes effect. Entrepreneurs may object to changes within 60 days; otherwise the amended terms apply.
11. Governing law and jurisdiction
These terms are governed by Austrian law. Mandatory consumer protection rules of the consumer's country of habitual residence remain unaffected.
